These Terms of Use (“Terms”) govern your access to and use of the MediaMotionPortal Video Production Asset Portal (“MediaMotionPortal,” “VPAP,” or “Portal”) and related websites and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.
1. Eligibility and Accounts
The Portal is intended for professional use by freelance videographers, photographers, editors, dealership personnel, and internal company team members who are at least 18 years of age. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
2. Acceptable Use
You agree to use MediaMotionPortal only for lawful purposes and in accordance with these Terms and any applicable policies. You may not:
- Access or attempt to access the Portal without proper authorization.
- Interfere with or disrupt the security, integrity, or performance of the Services.
- Upload, share, or transmit any content that is unlawful, harmful, or infringes the rights of others.
- Reverse engineer, decompile, or otherwise attempt to derive the source code of the Services.
- Use automated scripts or scraping tools to access or collect information from the Portal without our permission.
3. Content and Intellectual Property
MediaMotionPortal, including its design, logos, text, graphics, and software, is owned by or licensed to MediaMotionPortal and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non exclusive, non transferable license to access and use the Portal solely for approved business purposes.
By uploading or submitting content to the Portal, you represent that you have the necessary rights to do so and grant us and our dealership partners a limited license to use, store, reproduce, and display that content as needed to operate the Services and fulfill assigned production projects.
4. SMS / Text Message Terms
These SMS / Text Message Terms of Service (“SMS Terms”) govern your receipt of text messages from MediaMotionPortal in connection with the Portal. By opting in to receive SMS communications, you agree to these SMS Terms.
4.1 Program Description
MediaMotionPortal operates a freelancer and production management portal used by freelance videographers, photographers, editors, and dealership personnel across our network. We send SMS messages for the following purposes:
- Job notifications: new assignment availability, project briefs, and booking confirmations for freelance contributors.
- Production reminders: shoot date reminders and logistical updates sent to dealership representatives and talent.
- Upload and workflow alerts: notifications to team members and editors when assets are submitted, reviewed, or require action.
- Account and access communications: password resets, two factor authentication codes, and account status updates.
- Operational updates: schedule changes, approval requests, or urgent project communications.
4.2 How to Opt In
You may opt in to receive SMS communications from us by one or more of the following methods:
- Checking the SMS consent box during account registration on the MediaMotionPortal site.
- Providing your mobile phone number and affirmatively consenting via a web form.
- Texting a designated keyword to our short code or long code number as directed within the Portal.
By opting in, you confirm that you are the account holder or have authorization to use the mobile number provided and that you consent to receive automated text messages from us at that number.
4.3 Consent Is Not a Condition of Service
Your consent to receive marketing or promotional SMS messages is not required as a condition of using MediaMotionPortal or receiving any services. Certain transactional and operational messages (such as upload confirmations and job assignment notifications) may be necessary for platform functionality.
4.4 Message Frequency
Message frequency will vary based on your role within the Portal and active project volume. Freelance contributors and dealership personnel may receive multiple messages per day during active production periods. You can manage notification preferences within your account settings.
4.5 Message and Data Rates
Message and data rates may apply. These charges are billed by and payable to your mobile carrier. We are not responsible for any charges incurred as a result of SMS communications. Contact your mobile carrier for information about your plan’s messaging rates.
4.6 How to Opt Out
You may opt out of SMS communications at any time using any of the following methods:
- Reply STOP to any SMS message you receive from us.
- Log in to your MediaMotionPortal account and update your notification preferences.
- Contact us directly using the contact information in Section 8.
After opting out, you will receive a single confirmation message. You will no longer receive SMS messages from us unless you opt back in. Opting out of SMS will not cancel your account or affect your access to MediaMotionPortal.
4.7 Help and Support
For help with SMS communications, reply HELP to any message you receive from us, or contact our support team using the information in Section 8. You may also text HELP to our number at any time.
4.8 Supported Carriers
SMS messaging is available through most major U.S. mobile carriers. We are not liable for delayed or undelivered messages. Supported carriers include but are not limited to: AT&T, Verizon, T Mobile, Sprint, Boost Mobile, Cricket, and U.S. Cellular. Carrier availability is subject to change.
4.9 Automated Messaging
By opting in, you acknowledge and agree that MediaMotionPortal and third parties acting on our behalf may deliver text messages to you using an automated system for the selection or dialing of telephone numbers, including artificial or prerecorded messages, to the telephone number(s) you have provided, even if those numbers are on a federal or state Do Not Call registry or result in a charge to you. This disclosure is made in compliance with the Telephone Consumer Protection Act (TCPA) and applicable regulations.
5. Privacy
Information collected in connection with your use of the Services, including our SMS program, is governed by our Privacy Policy, available on the MediaMotionPortal site. We do not sell, rent, or share your mobile phone number with unaffiliated third parties for their own marketing purposes.
6. Disclaimers and Limitation of Liability
The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the Services will be uninterrupted, error free, or secure.
To the maximum extent permitted by law, MediaMotionPortal will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Services, even if advised of the possibility of such damages.
7. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date at the top of this page and, where appropriate, notify you via the Portal, by email, or by SMS. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.
